Important summary
FindMyPerson is a platform for adults to discover and communicate with other members. We do not guarantee a match, relationship, response or compatibility. Members are responsible for their own interactions and decisions.
Who operates FindMyPerson: FindMyPerson is operated by Alternative Brands NZ, NZBN 9429051545697, trading through findmyperson.co.nz. References in these Terms to “FindMyPerson”, “we”, “us” or “our” mean the operator of the FindMyPerson service.
Our Community Guidelines provide a plain-language summary of expected behaviour. These Terms and Conditions contain the more detailed rules that apply to use of the service.
1
Agreement to these terms
By creating an account, accessing member features, purchasing a paid service or otherwise using FindMyPerson, you agree to these Terms and Conditions and any policies expressly incorporated into them.
If you do not agree to these terms, you must not create an account or use the service.
2
Eligibility
You must be at least 18 years old to create or use a FindMyPerson account. By registering, you confirm that you are legally able to enter into this agreement and that the information you provide about your age and identity is truthful.
You must not use FindMyPerson if you have previously had an account terminated and we have told you that you may not create another account, unless we give you written permission to return.
3
Your account and profile
You are responsible for keeping your login details secure and for activity carried out through your account. Tell us promptly if you believe somebody else has gained unauthorised access.
Profile information must be genuine
You must provide information that is substantially accurate and must not impersonate another person, deliberately misrepresent your identity, use another person's photographs as your own, or create an account intended to deceive other members.
You should keep important profile information reasonably current. We may request information reasonably necessary to investigate suspected misuse, verify eligibility or protect the service and its members.
Personal and non-transferable accounts
Your account is personal to you. You must not sell, transfer, lend or share control of it with another person, or operate an account primarily on another person's behalf. We may restrict duplicate or replacement accounts where they are used to evade a block, suspension, termination, reporting process or other account restriction.
AI-generated and materially altered content
You must not use artificial intelligence, face-swapping, deepfakes, synthetic images or materially altered photographs or profile content to deceive members about who you are or materially misrepresent your identity, appearance or circumstances. Ordinary editing, accessibility tools, spelling assistance or writing assistance is not prohibited where it does not create a materially false impression.
4
Member conduct
You must use FindMyPerson respectfully and lawfully. You must not use the service to:
- harass, threaten, stalk, intimidate, bully or abuse another person;
- send unwanted explicit sexual material or repeatedly contact someone who has asked you to stop;
- promote hatred, violence, exploitation or unlawful discrimination;
- commit or facilitate fraud, romance scams, financial solicitation or deceptive commercial activity;
- use deception, pressure or exploitation to request or obtain money, cryptocurrency, gift cards, loans, investments, financial account access, passwords, banking credentials or other financial benefits or sensitive information;
- publish another person's private information or private communications without an appropriate lawful basis;
- upload content you do not have the right to use;
- use bots, scraping, automated account creation, bulk messaging or other systems that interfere with normal use of the service;
- attempt to bypass a block, suspension, account restriction or technical security measure; or
- use FindMyPerson for any unlawful purpose.
Additional practical expectations are set out in our Community Guidelines.
Never send money because someone you met through FindMyPerson asks you to. Requests for money or investments, especially early in an online relationship, should be treated cautiously and may be reported to us.
5
Reports and our three-strike safety policy
Members can report behaviour they genuinely believe may breach these Terms, our Community Guidelines or create a safety concern. Reports must be made in good faith.
Three reports from different members
If an account receives reports from three different member accounts, the reported account will be automatically locked as a precaution while it is reviewed. An automatic lock is not, by itself, a finding that the reported member has done anything wrong.
We may disregard reports that appear duplicate, coordinated, fraudulent, retaliatory, abusive or otherwise unreliable. We may also take action against accounts that deliberately misuse the reporting system.
We do not have to wait for three reports
The three-report threshold is a safety backstop, not a requirement that serious behaviour occur three times. We may immediately restrict, suspend or terminate an account after a single report or based on information available to us where we reasonably consider the conduct sufficiently serious or immediate action appropriate.
Following review, an account may be restored, warned, restricted, suspended or terminated. Repeated misconduct or serious misconduct may result in permanent termination.
6
Serious off-platform conduct
Where credible information indicates serious conduct connected with a FindMyPerson interaction, we may consider relevant off-platform behaviour when assessing member safety or account access. This may include credible evidence of threats, stalking, violence, fraud, sexual misconduct, coercion or serious harassment.
We will consider the nature, reliability, relevance and context of the information available to us. An allegation alone does not automatically establish wrongdoing.
8
Dating and personal safety
FindMyPerson provides tools intended to support safer interactions, but we cannot verify every statement made by every member or guarantee another person's identity, intentions, background or conduct.
You are responsible for deciding whether, when and how to communicate with or meet another member. Take sensible precautions when sharing personal information or meeting someone in person. See our Safety page and dating safety guide.
FindMyPerson is not an emergency service. If you or another person is in immediate danger, contact the appropriate emergency service.
9
Your content and our service
You retain ownership of content you submit, such as profile text and photographs. You give FindMyPerson a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format and technically process that content to the extent reasonably necessary to operate, secure, moderate and provide the service.
You confirm that you have the rights necessary to submit your content and that our permitted use of it will not knowingly infringe another person's rights.
We may remove or restrict access to content where we reasonably believe it breaches these Terms, our policies, applicable law, or creates a material safety or service-integrity concern.
FindMyPerson intellectual property
Except for member content and third-party material, the FindMyPerson name, branding, website design, software, databases, text, graphics and other platform material are owned by or licensed to the operator and are protected by applicable intellectual-property law. You may use the service for its intended personal purpose, but you must not copy, scrape, republish, sell, commercially exploit, reverse engineer or create an unauthorised derivative of protected FindMyPerson material except where the law expressly permits it.
10
Matching, introductions and service availability
Profile suggestions, search results, compatibility information and introductions are tools to help members discover one another. They are not guarantees or professional assessments of compatibility, suitability or safety.
We do not guarantee that you will receive matches, messages, replies, dates or any particular outcome from using FindMyPerson.
We may change, improve, test, add, remove or temporarily suspend features where reasonably necessary to operate, maintain or develop the service. Planned material changes affecting a paid service will be communicated where appropriate.
11
Payments, paid features and refunds
Where FindMyPerson offers paid memberships or features, the price, billing period, included features and any renewal arrangement will be shown before purchase. You are responsible for providing a valid payment method and paying applicable charges.
If a recurring subscription is offered, the renewal terms and method of cancellation will be disclosed at the time of purchase. Cancelling a recurring subscription stops future renewals but does not ordinarily reverse charges already validly incurred.
Prices offered to New Zealand consumers will state the applicable currency and will include GST where required. Any material fees, renewal conditions or other important purchase conditions will be displayed before purchase.
Account action for misconduct
If your account is restricted, suspended or terminated because we reasonably determine that you breached these Terms or our Community Guidelines, fees already paid will not be refunded merely because of that account action.
Your legal rights still apply. Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law. Where the law requires a refund or other remedy, that legal requirement prevails over the paragraph above.
12
Privacy and personal information
Use of a dating service involves personal information. Our collection, use, storage and disclosure of personal information is governed by our Privacy Policy and applicable New Zealand privacy law.
Members must also respect the privacy of other members. You must not misuse information obtained through FindMyPerson or use the service to build unauthorised databases of member information.
Service and marketing communications
We may send communications reasonably necessary to operate your account or provide the service, such as security notices, account actions, payment information and important service updates. Marketing or promotional communications will be handled separately and will include an unsubscribe method where required by law. Unsubscribing from marketing does not prevent essential account or service communications.
13
Account restriction, suspension and termination
We may take proportionate action where we reasonably believe an account or its activity breaches these Terms, threatens member safety, compromises service security, involves fraud or misuse, or creates a material legal or operational risk.
Action may include removing content, limiting messaging or other features, requiring verification, temporarily locking an account, suspending access or permanently terminating the account.
Serious misconduct may result in immediate termination without prior warning. Repeated misconduct may also result in termination, including where earlier warnings or restrictions have not resolved the behaviour.
Where reasonably practicable and appropriate, we may tell you the general reason for account action. We may withhold information where disclosure could compromise another person's privacy or safety, an investigation, fraud prevention, security measures or a legal obligation.
14
Responsibility and liability
FindMyPerson provides a platform through which members can discover and communicate with one another. Members are responsible for their own statements, decisions, interactions and conduct.
To the maximum extent permitted by law, we are not responsible for losses caused solely by the independent acts or omissions of another member that we could not reasonably have prevented. Nothing in these Terms limits liability, rights or remedies where doing so would be unlawful.
You are responsible for maintaining appropriate access to your own device, internet connection and account credentials.
13
Events outside our reasonable control
We are not responsible for a delay or failure to provide the service to the extent it is caused by circumstances reasonably outside our control, such as major telecommunications or hosting failures, natural disasters, widespread power outages, serious cyber incidents, government action or other comparable events. We will take reasonable steps to restore affected services where practicable. This clause does not exclude any right or remedy that cannot lawfully be excluded.
14
General contractual provisions
No waiver
If we do not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later. A waiver relating to one event does not automatically apply to another event.
Entire agreement
These Terms, together with policies expressly incorporated into them, including the Community Guidelines and Privacy Policy where applicable, form the agreement governing your use of FindMyPerson. Nothing in this clause excludes liability for misleading conduct or overrides rights that cannot lawfully be excluded.
17
Changes to these Terms
We may update these Terms where reasonably necessary, including to reflect changes to the service, law, safety practices or business operations. The current version will be published on this page with its effective or updated date.
If a change is material to an existing paid service or materially affects member rights or obligations, we will take reasonable steps to provide appropriate notice before the change takes effect, unless an urgent change is required for legal, security or safety reasons.
18
New Zealand law and consumer rights
These Terms are governed by New Zealand law. Nothing in them is intended to exclude or reduce rights you have under New Zealand consumer or privacy legislation where those rights cannot lawfully be excluded or reduced.
If part of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
19
Questions, concerns and disputes
If you have a question about these Terms, a payment, an account decision or the service, please contact FindMyPerson using the contact details provided on the website. We encourage members to contact us first so we have an opportunity to review and respond to the issue.
These Terms do not prevent you from using any external complaint, dispute-resolution or legal process available to you under New Zealand law.
